Acceptance of Terms
Agreement
By accessing or using AEther Handmade, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing this site.
Eligibility
You must be at least 18 years old to use our services. By using AEther Handmade, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into these terms.

Certain features may be subject to additional terms or policies. Your use of those features constitutes acceptance of those additional terms.
Account Responsibilities
Account Creation
You must provide accurate, complete, and current information when creating an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.
Account Security
You agree to notify us immediately of any unauthorized use of your account. We are not liable for any loss or damage arising from your failure to protect your account credentials.
One Account Per Person
Each person may only maintain one buyer account. Creators may have one associated vendor account. Multiple accounts may be terminated without notice.
Buyer Terms
Purchasing
When you place an order, you are making an offer to purchase. The creator may accept or decline your order. Once accepted, you are obligated to complete the purchase unless you and the creator mutually agree to cancel.
Payment
You agree to pay the full price for items purchased plus any applicable shipping, taxes, and fees. All payments are processed through our secure payment system. You represent that you have the right to use any payment method you provide.
Reviews
You may leave reviews for purchases you have made. Reviews must be honest, accurate, and based on your actual experience. We reserve the right to remove reviews that violate our policies.
Communication
You agree to communicate with creators respectfully and in good faith. Harassment, threats, or abusive behavior toward creators is prohibited and may result in account termination.
Creator Terms
Eligibility
Creators must be approved through our application process. You must be legally authorized to sell the items you list and comply with all applicable laws regarding your business.
Handmade Requirement
All items must be genuinely handmade by you or your small team. Mass-produced items, dropshipped goods, and resold items are strictly prohibited. Violations may result in immediate shop closure.
Accurate Listings
You must provide accurate descriptions, photos, and pricing for your items. Misrepresentation of items is prohibited and may result in account termination.
Order Fulfillment
You agree to fulfill orders within the timeframe specified in your listings. If you cannot fulfill an order, you must notify the buyer promptly and issue a full refund.
Customer Service
You are responsible for providing customer service for your orders, including responding to inquiries, handling returns per your stated policy, and resolving disputes in good faith.
Prohibited Conduct
General Prohibitions
You may not use our platform to: violate any laws; infringe intellectual property rights; harass, abuse, or harm others; distribute malware or spam; attempt to gain unauthorized access to our systems; or interfere with other users' enjoyment of the platform.
Prohibited Items
The following are prohibited: illegal items, weapons, drugs, counterfeit goods, items infringing intellectual property, hazardous materials, recalled items, and items violating our content policies. See our full prohibited items list for details.
Manipulation
Fee avoidance, fake reviews, shill bidding, and other forms of marketplace manipulation are strictly prohibited and will result in account termination.
Intellectual Property
Your Content
You retain ownership of content you create and post. By posting content, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute that content in connection with our services.
Our Content
The AEther Handmade name, logo, and all related marks are our trademarks. Our website design, features, and content are protected by copyright. You may not use our intellectual property without written permission.
Infringement Claims
We respect intellectual property rights. If you believe your work has been infringed, please submit a detailed notice to our designated agent. We will respond in accordance with applicable law.
Payments & Fees
Transaction Fees
Creators pay a commission on each sale as specified in the creator agreement. Fees are deducted from the sale price before payout. Fee rates are disclosed in your vendor dashboard.
Payouts
Creator payouts are processed according to the schedule in your vendor dashboard. You are responsible for providing accurate payment information and for any taxes owed on your earnings.
Refunds
Refunds are processed according to the creator's stated return policy. When refunds are issued, applicable fees may be returned to the creator as described in the creator agreement.
Currency
All prices are displayed in US dollars unless otherwise indicated. Currency conversion fees may apply for international transactions.
Disclaimers
Platform Role
AEther Handmade is a marketplace connecting buyers and creators. We are not a party to transactions between buyers and creators. We do not guarantee, endorse, or assume responsibility for any products or services offered by creators.
As-Is Service
Our services are provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that our services will be uninterrupted, error-free, or secure.
Third-Party Services
Our platform may contain links to third-party websites or services. We are not responsible for the content, policies, or practices of any third-party sites or services.
Limitation of Liability
Limitation
To the maximum extent permitted by law, AEther Handmade and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services.
Cap on Liability
Our total liability for any claims arising from these terms or your use of our services shall not exceed the greater of $100 or the amounts paid by you to AEther Handmade in the 12 months prior to the claim.
User Disputes
We are not responsible for disputes between buyers and creators. While we may assist in mediation, the resolution of such disputes is ultimately between the parties involved.
Dispute Resolution
Informal Resolution
Before filing any formal claim, you agree to try to resolve the dispute informally by contacting us. We will try to resolve the dispute through good-faith negotiation.
Arbitration
Any disputes not resolved informally shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You waive your right to a jury trial and to participate in class actions.
Governing Law
These terms are governed by the laws of the State of Delaware, without regard to its conflict of laws principles.
Termination
By You
You may terminate your account at any time by following the account deletion process. Termination does not relieve you of obligations incurred before termination, including pending orders.
By Us
We may suspend or terminate your account at any time for any reason, including violation of these terms. We will provide notice when practicable, but immediate termination may occur for serious violations.
Effect of Termination
Upon termination, your right to use our services ceases immediately. Provisions that by their nature should survive termination will survive, including intellectual property rights, disclaimers, and limitations of liability.
Changes to Terms
Modifications
We may modify these terms at any time. We will provide notice of material changes by email or by posting a notice on our website. Your continued use after changes take effect constitutes acceptance.
